Terms and Conditions

1. INTRODUCTION

These Terms and Conditions ("Terms") govern all services provided by Elemental Frequencies Shamanic Services ("Elemental Frequencies," "we," "us," or "our"), a registered business operating in Edmonton, Alberta, Canada, owned and operated by Jaleen Starratt. By booking a session, completing an intake form, purchasing a package, or otherwise engaging with our services, you ("the client") agree to be bound by these Terms in their entirety.

If you do not agree to these Terms, please do not book or proceed with any service.

2. NATURE OF SERVICES

2.1 Services Offered Elemental Frequencies Shamanic Services offers Quantum Business Breakthrough Coaching, Shamanic Meditative Journeys, Antojai Student Coaching Services, other services contracted on a case-by-case basis at the client's request, and related spiritual services utilizing Antojai Quantum Reiki® and Antojai Alchemy®, delivered via Zoom.

2.2 Not Medical or Psychological Treatment All services offered by Elemental Frequencies Shamanic Services are complementary in nature and do not constitute medical treatment, psychological therapy, or mental health counselling. It is not the role of Jaleen Starratt to provide any medical or psychological diagnoses, and no such diagnoses will be made or implied.

All services are intended to complement, not replace, professional medical or psychological care. It is the client's sole responsibility to:

- Maintain regular contact with their medical and mental health professionals

- Advise their medical professionals that they are exploring complementary alternative services

- Monitor their medications and consult their doctor regarding any adjustments required

- Ensure their medical care remains current and up to date throughout their engagement with Elemental Frequencies

- By booking any service, you acknowledge and agree to these terms.

2.3 No Guarantee of Results Results from sessions and programs are entirely dependent upon the client's honesty, participation, commitment, and follow-through. Elemental Frequencies does not guarantee specific outcomes. No session will be guaranteed where services are rendered based upon false, incomplete, or misleading information provided by the client.

Your long-term success is dependent upon your active implementation of any success plan, homework, or aligned actions assigned during or following your sessions. A new reality cannot be created by perpetuating old structures and old habits. You hold sovereign responsibility for the results you experience.

3. SOVEREIGNTY AND RESPONSIBILITY

You hold complete sovereignty, responsibility, and power over how you receive, interpret, and act upon the insights, impressions, channeled guidance, and energy work experienced in your sessions. Results are a direct reflection of your participation, commitment, and action.

While sessions work at the energetic root of what is being addressed, your free will remains fully intact at all times. If you choose to perpetuate negative cycles following a session, your free will has the power to undo any shifts that occurred. Elemental Frequencies cannot be held responsible for outcomes where the client has not implemented the recommended actions or has actively chosen to continue patterns that contradict the work done in session.

By booking any service, you accept full sovereign responsibility for your own outcomes.

4. PROGRAM CONTRACT REQUIREMENT

For all coaching packages and programs, a formal contract must be signed by both the client and Jaleen Starratt before the program can commence. This contract outlines:

- The terms of the program

- The responsibilities of each party

- Copyright and brand protection of Antojai Alchemy and related proprietary frameworks

- Payment terms

No sessions will be held and no program will commence until the contract has been signed by both parties. If, upon scheduling, the client does not agree to the terms of the contract, the program will be cancelled. Payment terms in this circumstance will be governed by the cancellation and refund policy outlined in Section 6.

5. PAYMENT TERMS

5.1 Payment in Full All services must be paid in full prior to the commencement of any session or program, unless an alternative payment arrangement has been explicitly agreed upon in writing and documented within a signed contract.

5.2 Currency All prices are listed and charged in Canadian Dollars (CAD).

5.3 Payment Platforms Payments are processed securely through Stripe and PayPal. By submitting payment you agree to the terms and conditions of the relevant payment platform.

5.4 Circumstantial Payment Plans In limited and exceptional circumstances, alternative payment arrangements may be made at the sole discretion of Jaleen Starratt. Any such arrangement will be documented and agreed upon in a signed contract prior to the commencement of services. No payment plan is in effect unless confirmed in writing and documented within a signed contract.

6. CANCELLATION, RESCHEDULING, AND REFUND POLICY

6.1 No Refunds Due to the significant preparation of time, energy, and intention invested in every appointment prior to the session taking place, all sales are final. Cancellations and refunds are not available under any circumstances once payment has been made.

6.2 Rescheduling Sessions may be rescheduled provided that written notice is given at least 24 hours prior to the scheduled appointment time. Rescheduling requests made less than 24 hours before the appointment will be treated as a forfeited session with no rescheduling or refund available.

6.3 Late Arrivals If a client is more than 30 minutes late to their scheduled session, the session is forfeited in full with no rescheduling or refund available. Time and energy are invested in your appointment prior to your arrival. Please honour your scheduled time or reschedule in advance.

6.4 Program Cancellation Prior to Contract Signing If a client books a coaching package and subsequently declines to sign the required program contract, the program will be cancelled. Refund eligibility in this circumstance will be determined on a case-by-case basis at the sole discretion of Jaleen Starratt.

7. CLIENT CONDUCT

Elemental Frequencies Shamanic Services operates within a sacred energetic container. All clients are expected to engage with respect, integrity, and honesty at all times.

Derogatory comments, threats, harassment, or abuse of any kind directed toward Jaleen Starratt, Elemental Frequencies Shamanic Services, or the sacred alchemy of this work will not be tolerated under any circumstances. In the event of such conduct:

- The session will be immediately terminated with no refund issued

- All future session requests from the client will be declined

- The client may be referred to another practitioner at Jaleen Starratt's sole discretion

Elemental Frequencies reserves the right to refuse or terminate service to any individual whose conduct is deemed disrespectful, dishonest, or energetically misaligned with the integrity of this work.

8. HONESTY AND INTEGRITY

To experience the highest level of shift, it is necessary for the client to be entirely honest about the full scope of their experience, history, and intentions. Sessions conducted on the basis of false, incomplete, or misleading information will not be guaranteed, and Elemental Frequencies cannot be held responsible for outcomes where full disclosure was not provided.

By booking a session, you confirm that all information provided in your intake form and during your sessions is honest, accurate, and complete to the best of your knowledge.

9. INTELLECTUAL PROPERTY

9.1 Antojai® Brand Protection Antojai Alchemy®, Antojai Quantum Reiki®, and all related frameworks, methodologies, and terminology are the intellectual property of the Antojai Ascension Academy and Master Axél Antojai. These are protected by copyright. Their use within Elemental Frequencies Shamanic Services is licensed through Jaleen Starratt's certified training and apprenticeship. Unauthorised use, reproduction, or replication of these frameworks is strictly prohibited.

9.2 Session Content All session content, recordings, meditations, audio productions, notes, and materials produced by Elemental Frequencies Shamanic Services are the intellectual property of Jaleen Starratt and Elemental Frequencies Shamanic Services. Session recordings and materials are provided to clients for personal use only. They may not be reproduced, redistributed, shared publicly, or used for commercial purposes without the prior written consent of Jaleen Starratt.

9.3 Website and Content All content on elementalfrequencies.biz, including written content, imagery, and brand materials, is the intellectual property of Elemental Frequencies Shamanic Services and may not be reproduced or used without express written permission.

10. CONFIDENTIALITY

Jaleen Starratt treats all client information, session content, and personal disclosures with the utmost confidentiality. Personal information is handled in accordance with our Privacy Policy, available at elementalfrequencies.biz.

Client information will never be shared with third parties without explicit written consent, except where required by law. Please refer to our full Privacy Policy for details on how your information is collected, stored, and protected.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Elemental Frequencies Shamanic Services and Jaleen Starratt shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or related to the use of our services, including but not limited to:

- Emotional or psychological distress experienced during or following a session

- Decisions made by the client based on insights or impressions received in session

- Outcomes resulting from the client's failure to implement recommended actions

- Any interruption or technical failure of third-party platforms used to deliver services

By booking any service, you acknowledge that you are engaging with complementary spiritual services of your own free will and accept full personal responsibility for your experience and outcomes.

12. GOVERNING LAW

These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, regardless of the client's location. Any disputes arising from these Terms or from the delivery of services shall be subject to the exclusive jurisdiction of the courts of Alberta, Canada.

13. MODIFICATIONS TO THESE TERMS

Elemental Frequencies Shamanic Services reserves the right to update or modify these Terms and Conditions at any time. Updated Terms will be posted on this page with a revised effective date. Your continued engagement with our services following any changes constitutes your acceptance of the updated Terms.

14. TESTIMONIALS AND MARKETING CONSENT

By engaging with Elemental Frequencies Shamanic Services, you consent to Jaleen Starratt using any unsolicited testimonials, feedback, reviews, or success stories you share, whether submitted through Google Reviews, email, social media, or direct communication , for marketing and promotional purposes across all platforms, including but not limited to the Elemental Frequencies website, social media channels, and promotional materials.

Your full name will never be used without your explicit written consent. Testimonials may be attributed to a first name only unless you expressly agree otherwise.

You may withdraw your consent for the use of your testimonial at any time by contacting us at [email protected]. Withdrawal of consent will not affect any prior use of the testimonial.

Testimonial Accuracy Disclaimer Testimonials and results shared in marketing materials represent individual client experiences only. They are not guaranteed outcomes. Results vary and are entirely dependent upon each client's unique circumstances, honesty, commitment, and participation. No testimonial constitutes a promise or guarantee of similar results.

15. RECORDING CONSENT

By booking any session with Elemental Frequencies Shamanic Services, you explicitly consent to your session being recorded for the purpose of providing you with a session recording as part of your service. This consent is in addition to any consent provided within your intake form.

Session recordings are stored securely within a contracted secure storage platform and are accessible only to Jaleen Starratt and the client. Recordings will not be shared with any third party without your explicit written consent.

If you do not consent to being recorded, you must notify Jaleen Starratt in writing prior to your scheduled session. Please be aware that session recordings are included as part of your service deliverables, and opting out may affect your ability to receive a full session recording.

16. FORCE MAJEURE

Elemental Frequencies Shamanic Services shall not be held liable for any failure or delay in delivering services resulting from circumstances beyond our reasonable control, including but not limited to illness, family emergency, natural disaster, acts of God, government restrictions, power outages, or technology failures affecting third-party platforms.

In the event of a force majeure circumstance, Elemental Frequencies will make every reasonable effort to reschedule affected sessions at the earliest mutually available time. No refunds will be issued for sessions postponed due to force majeure circumstances. Rescheduled sessions will be offered at no additional cost to the client.

17. TECHNICAL DIFFICULTIES

Elemental Frequencies Shamanic Services delivers all sessions via Zoom. While every effort is made to ensure a stable and uninterrupted session, Elemental Frequencies cannot be held responsible for technical difficulties arising from third-party platform failures, internet connectivity issues on either side, or device malfunctions.

In the event of a technical disruption during a session:

- Elemental Frequencies will attempt to reach the client by phone to resume the session by phone. If that is not possible:

- If the disruption occurs within the first 10 minutes and the session cannot be resumed, the session will be rescheduled at no additional cost

- If the disruption occurs after the first 10 minutes and the session cannot be resumed, the remaining time will be assessed and a partial rescheduled session will be offered at the sole discretion of Jaleen Starratt

Clients are responsible for ensuring their technology, internet connection, and Zoom access are functioning prior to their scheduled session time.

18. DISPUTE RESOLUTION

In the event of a dispute arising from these Terms or from the delivery of services, both parties agree to first attempt resolution through good faith communication directly with Jaleen Starratt at [email protected].

If direct communication does not resolve the dispute within 30 days, both parties agree to pursue mediation through a mutually agreed upon mediator in Edmonton, Alberta, before initiating any formal legal proceedings. The cost of mediation will be shared equally between both parties unless otherwise agreed.

Nothing in this clause prevents either party from seeking urgent injunctive or equitable relief from a court of competent jurisdiction where necessary to prevent irreparable harm.

19. ENTIRE AGREEMENT

These Terms and Conditions, together with any signed program contract, intake form, and booking confirmation, constitute the entire agreement between Elemental Frequencies Shamanic Services and the client with respect to the services described herein. They supersede all prior discussions, representations, understandings, and agreements, whether verbal or written, relating to the subject matter of these Terms.

No verbal representation, promise, or assurance made before or during the delivery of services shall be binding unless it is documented in writing and forms part of a signed contract between both parties.

20. SEVERABILITY

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from these Terms. The remaining provisions shall continue in full force and effect and shall not be affected by the severance of the invalid or unenforceable provision.

21. WAIVER

The failure of Elemental Frequencies Shamanic Services to enforce any right or provision of these Terms on any occasion shall not constitute a waiver of that right or provision on any future occasion. No waiver of any term shall be deemed a further or continuing waiver of that term or any other term. Any exception made by Jaleen Starratt on a circumstantial basis does not set a precedent and does not obligate Elemental Frequencies to make the same exception in future.

22. AGE REQUIREMENT

All services offered by Elemental Frequencies Shamanic Services are intended for individuals aged 18 years and older. By booking any service, you confirm that you are at least 18 years of age.

Individuals under the age of 18 may only access services with the explicit written consent of a parent or legal guardian, who must also agree to these Terms on the minor's behalf and accept full responsibility for the minor's participation. Elemental Frequencies Shamanic Services reserves the right to request proof of age or parental consent at any time and to decline service where this requirement is not met.
